This agreement applies to MyRPG website ("Site"), its official Discord Server ("Discord"), and other content and services that are linked to this Agreement.

BY USING AND/OR VISITING MYRPG'S SITE OR DISCORD, INCLUDING ALL CONTENT AVAILABLE THROUGHOUT, YOU SIGNIFY YOUR CONSENT AND AGREEMENT TO THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS DO NOT USE THE SITE OR DISCORD. You attest that you are either

2. Site & Discord Access/Use

MyRPG hereby grants you permission to use the MyRPG Site and Discord as set forth herein, provided that:

• Your use of these is in accordance with our rated audience of users 13 years of age or older.
• You agree that the information provided is for convenience, information, and/or entertainment purposes only.
• We may use "cookies" and/or "web beacon" technology to provide features for the Site. You can read detailed information here as well as our Privacy Policy.
• You agree to not participate in the transaction of real currency. Common uses of this include commissions where this should take place off our Site and Discord.

3. Links Incoming & Outgoing

MyRPG has not reviewed all of the sites linked to its Site and is not responsible for the contents of any such linked site. The presence of any link does not imply endorsement by MyRPG of the site. The use of any linked website is at the User’s own risk.

Our Site may contain links to third-party (external) websites that are not owned or controlled by MyRPG. We have no control over and assume no responsibility for, the content, privacy policies, or practices of any third-party websites (including Discord).

We disclaim any and all warranties, express or implied, to any externally linked sites. By using our website you expressly relieve MyRPG from any and all liability arising from your use of any external website.

Users may share content from MyRPG by utilizing links to the content but may not copy, redistribute, or otherwise host the content elsewhere UNLESS it is the User's own intellectual property.

MyRPG trademarks, service marks, logos, and banners on the Site or Discord are owned by or licensed to MyRPG, its affiliates or associates, and are subject to copyright, trademark, and other intellectual property rights under applicable US laws.

The Site, along with the game systems, functions, ideas, and generated content, may not be used, copied, reproduced, distributed, transmitted, displayed, sold, licensed, or otherwise exploited for purposes not expressly authorized herein.

You agree that you may not engage in any use, copying, or distribution of any content available from or through the Site, other than as expressly permitted herein or as otherwise identified on the Site by MyRPG or the Member(s) who have created the content (User Submissions) you wish to use.

MyRPG reserves all rights not expressly granted herein.

You agree that your use of the Site and Discord shall be at your own risk.

To the fullest extent permitted by law, MyRPG, its owners, volunteers, management, its affiliates, or associates disclaim all warranties, express or implied, in connection with the Site and your usage.

MyRPG is provided AS IS. We make no warranties and assume no liability or responsibility for:

• unauthorized access to or use of our server and/or any and all personal information stored therein.
• interruption or cessation of transferral to or from the Site or Discord.
• bugs, viruses, trojan horses, worms, or similar which may be transmitted to or through the Site or Discord.
• the result of your use of any content from the Site or Discord.
• losses or damages of any kind.
• any real currency transactions placed on our site despite being against our ToS.

6. Limitations of Liability

MyRPG or its suppliers will not be held accountable for any damages that will arise with the use or inability to use the materials on the Site, even if MyRPG or an authorized representative of this Site has been notified, orally or written, of the possibility of such damage.

The materials appearing on this Site or Discord may include technical, typographical, or photographic errors. MyRPG will not promise that any of the materials on this Site are accurate, complete, or current. We may change the materials contained on the Site or Discord at any time without notice.

Any revisions made for clarification, addition, subtraction, or other nature to any guidelines on this site may be enforced fully including to any content distributed before the revision(s) were made.

Any instance of changes are not subject to notifying Users and may be added with or without notice.

We may revise these Terms of Service for the Site at any time without prior notice. By using this Site, you are agreeing to be bound by the current version of these Terms of Service even in the instance your agreement was made to a previous version.

Private messages, sometimes referred to as "Message" or "PM" or "DM", are stored on our database and are visible to Site Managers or team members with this permission. You acknowledge and allow these users permission to see these by using this feature.

10. User Submissions

A user may, where allowed on the Site or Discord, submit accounts, profiles, text-based content, and picture or video content collectively known as User Submissions. By submitting any User Submission to the Site or Discord you hereby waive any privacy expectations that you may have with respect to any such User Submission including any data or information submitted by you to the Site or Discord.

You acknowledge any User Submission created by you is available to Members and Guests. You acknowledge and agree that once submitted/created by you MyRPG shall have no obligation to remove, delete or disable access to any User Submission made by you including accounts.

You will retain copyright in your User Submissions, however, you hereby grant MyRPG an irrevocable, nonexclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, perform, and use in any other manner that may be hereafter developed in connection with the Site or its affiliates.

You agree not to submit a User Submission that contains any material that is copyrighted (or otherwise subjected to proprietary rights) unless you are the owner of such rights or have permission from the rightful owner to post the material and to grant MyRPG all of the licensed rights outlined herein. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to create the User Submission.

You agree not to submit any User Submission that violates our rated audience of users 13 years of age or older.

10.1 Removal of User Submissions

MyRPG may, at its sole discretion, remove or prevent access to, in whole or part, any material submitted by you for any reason or no reason.

We intend to protect all copyrights and will comply with the take-down procedures established under the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA") (https://www.copyright.gov/policy/section512/).
